Welcome to Appellate. These Terms and Conditions (“Terms”) govern your use of the Appellate platform (“Appellate,” “we,” “us,” or “our”), an end-to-end towing management system built for law enforcement agencies and their partners. By accessing or using Appellate, you (“you,” “your,” or “User”) agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Authorized Use
Appellate is designed for use by law enforcement agencies, government personnel, and authorized towing vendors. You agree to use the platform only for its intended purposes: to manage, track, and document towing operations in a manner that promotes transparency, compliance, and operational efficiency.
Unauthorized use, including data manipulation, improper access, or use outside the scope of official duties, is prohibited.
2. Account Access & Security
Certain features of Appellate require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Please notify us immediately if you suspect unauthorized use or a security breach.
3. Data Integrity & Confidentiality
Appellate may process sensitive information, including vehicle records, personal information, and agency data. You are responsible for ensuring that all information submitted is accurate, lawfully obtained, and used in compliance with relevant laws, regulations, and departmental policies.
You agree not to misuse or disclose any information accessed through the platform.
4. Ownership & Intellectual Property
Appellate and all associated content, software, logos, documentation, and features are the property of Appellate and its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
Use of Appellate grants you a limited, non-exclusive, non-transferable license to access the platform for authorized purposes only.
5. Platform Availability
We strive to ensure reliable access to Appellate but cannot guarantee uninterrupted availability. The platform may be subject to maintenance, updates, or technical issues.
Appellate is not responsible for any delays, disruptions, or loss of data due to system downtime.
6. Compliance with Law
You agree to use Appellate in accordance with all applicable federal, state, and local laws, including but not limited to towing regulations, public records policies, and criminal procedure requirements. Misuse of the platform may result in access suspension or legal consequences.
7. Third-Party Systems
Appellate may connect to third-party systems (e.g., DMV databases or payment gateways). We are not responsible for the accuracy, availability, or terms of those third-party services. Use of such services is governed by their own terms and conditions.
8. Limitation of Liability
Appellate is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed any fees paid by your agency in the 12 months prior to the claim.
9. Suspension or Termination
We reserve the right to suspend or terminate access to Appellate for any user or organization who violates these Terms, attempts to compromise system integrity, or uses the platform inappropriately.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will provide notice to account administrators or within the platform itself. Continued use of Appellate after updates are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.
